Sustainability within construction is an absolute must.

It was once framed around client appeal and environmental performance, but now, it is under close inspection from regulators and inspectors.

Issues such as waste management, emissions and resource use are increasingly enforceable with non-compliance resulting in fines, project delays and reputational damage.

Under standards issued by the Building Safety Act and ESG disclosure rules, poor practices damaging the environment can create legal and ethical exposure across projects.

Clients expect auditable sustainability performances within construction sites and contractors who fail to uphold these standards face consequences.

For construction sites to remain safe, sustainability needs to be incorporated into policies, site practices and procurement to turn environmental responsibility into the main point of compliance strategy rather than a sidelined initiative.

Regulatory overlap on site

Regulations now span health and safety, environmental standards, data protection and ESG reporting – all of which are intersecting on-site.

The Building Safety Act sets clear responsibilities, whilst environmental and sustainability regulations demand demonstrable performance across every stage of a project.

This convergence means construction sites must handle multiple regulators, overlapping obligations and a higher amount of inspections.

Breaches are rarely isolated and failures in one area, such as waste management, can create legal and ethical problems across the project.

“Construction firms are dealing with a regulatory environment that no longer operates in silos,” comments David Gilbertson, CEO at Wireless CCTV Ltd.

“Safety, sustainability, data protection and reporting obligations are increasing on site, which means compliance is more likely to have wider consequences if governance and accountability are no longer defined.”

For compliance leaders on a project, this expansion of regulations reinforces the need for integrated policies and oversight.

Sites must embed environmental, safety and reporting standards into everyday practice to ensure that sustainability and compliance are treated as core operational and ethical accountability.

Enforcement and site evidence

Compliance failures carry real consequences.

Waste, dust, noise, air quality and pollution are now under strict oversight under regimes, such as the Environmental Permitting Regulations (EPR) and local laws.

In a recent analysis by Qflow, waste transfer notes found only 64% compliance, meaning one in three documents lacked legal details.

This included missing permits or carrier licences, exposing firms to regulatory action.

National regulators carried out 11,000+ on-site EPR inspections in 2024.

This highlighted the scale of oversight and the expectation of intensive documentation.

Alongside this, noise pollution incidents related to construction projects have been recorded in the dozens, showing why noise and emissions require proactive management plans.

ESG credibility under scrutiny

Sustainability expectations are now reaching down to the site level, where environmental performance, labour practices and governance standards need to align with what sites are reporting.

Sustainability frameworks remain focused on consistency, transparency and accountability, which places pressure on construction sites to demonstrate how ESG commitments integrate into day-to-day operations.

This has resulted in the need for accurate, auditable environmental data that shows the real activity on site.

When reporting is misaligned with the operations, the risk of greenwashing becomes important.

Regulators, clients and funders are alert to the gap and vague claims can undermine credibility and impact trust.

Construction firms are under scrutiny during procurement and funding decisions.

ESG performance is no longer assessed separately but as a core indicator of long-term risk management, governance and compliance maturity.

Digital oversight and GDPR

As construction sites adopt more digital oversight to support safety and sustainability, data protection has become critical.

Environmental monitoring, access control and site oversight generate personal data, bringing GDPR obligations directly on-site rather than just head office.

“As digital oversight becomes more common on construction sites, organisations must ensure data protection is considered from the outset,” states Gilbertson.

“Collecting data for safety or sustainability reasons does not remove the obligation to process it lawfully, transparently and responsibly.”

To collect data for safety and sustainability purposes, it’s important to still meet legal requirements surrounding lawful processing and transparency.

Firms need a clear understanding of why data is being captured, how long it is kept and who has access to it.

Without this transparency, well-intentioned monitoring can create a compliance risk unintentionally.

Tools deployed to improve oversight can expose organisations to data protection breaches if the policies are not clearly defined.

For compliance leaders, aligning with digital oversight is essential to ensure that sustainability and safety initiatives strengthen regulatory compliance.

Supply chain shared liability

Ethical obligations extend across supply chains, where subcontractors, suppliers and partners all contribute to the site’s performance.

As a result, sustainability failures sometimes originate with third parties, yet the consequences are shared across all.

Inconsistent compliance standards remain challenging.

Different levels of environmental awareness, record-keeping and governance across subcontractors can undermine compliance frameworks.

When oversight is weak, firms risk exposure through inaccurate reporting, breaches or contractual issues.

Shared liability is becoming harder to ignore.

Contracts put responsibility on contractors to ensure sustainability and compliance standards are upheld throughout the supply chain.

This makes third-party oversight a priority.

Effective due diligence, clear expectations and ongoing monitoring are now crucial to managing risk and ensuring that sustainability commitments are delivered across every stage of a project.

Reporting as compliance control

Compliance reporting is now the foundation of sustainable construction.

If sustainability measures can’t be proven, they are difficult to defend during inspections, audits or investigations.

As scrutiny increases, incomplete or fragmented records are not seen as administrative oversights, but as indicators of weak compliance control.

It’s challenging for construction firms to be aligned with environmental data, health and safety records and ESG disclosures, as many are often reported through separate processes.

This risks inconsistency or gaps and where reporting is disjointed, sites struggle to demonstrate accountability across projects.

As a result, compliance reporting is evolving into a strategic discipline, underpinning regulatory confidence, commercial credibility and long-term risk management.

Compliance leaders have a clear list of priorities.

Sustainability is a non-negotiable that must be embedded into compliance frameworks.

At the same time, ESG data accuracy and reporting processes need to be strengthened to support transparency and withstand external scrutiny.

Preparing for audits and inspections

Construction sites must prepare for a regulatory environment defined by increased inspections, audits and accountability.

Proactive compliance, supported by clear reporting and oversight, will be essential.

For construction leaders, the ability to evidence sustainability and compliance is no longer confined to the office, but it is central to maintaining trust, securing work and delivering projects responsibly.

Winchester arrests raise construction site fraud concerns, BESA says

Fraud allegations linked to CSCS cards

Four men arrested in Winchester last week are suspected of accepting payment to help unqualified people gain Construction Skills Certification Scheme (CSCS) cards without completing a genuine training course.

The Building Engineering Services Association (BESA) said the suspected fraudulent test centre should act as a reminder for those responsible for health and safety on construction sites.

Police reported that gaming the system in this way would allow unqualified and inadequately trained people to gain access to construction sites and could put themselves and others at risk of serious harm.

Digital checks and the Engineering Services SKILLcard

Jill Nicholls, Director Of Competence And Compliance at BESA, said: “This incident should remind everyone that we cannot be complacent about health and safety despite all the measures the industry has put in place in recent years.

“We now have an advanced digital system for verifying that card holders are genuine and have completed the appropriate training for their specific work areas, and we would encourage everyone to use the system proactively, especially if they have any suspicions about someone’s qualifications.”

BESA operates the CSCS partner card scheme Engineering Services SKILLcard, which allows card holders and inspectors to access technical and health and safety qualifications in real time via a mobile phone app.

The association said the system also allows cancellation of counterfeit or revoked cards.

It said the SKILLcard has been operating for over 24 years and provides more than 55,000 building services engineers with evidence of the qualifications they need to access sites.

It also said the digital Engineering Services SKILLcard gives users a single continually updated point of access to all their cards and the qualifications they hold.

The system can enable site access via a QR code that can be scanned directly from the card holder’s phone using the CSCS Smart Check App.

BESA said digitisation formed part of the sector’s response to the Building Safety Act, which came into force in 2022, and was intended to increase scrutiny of individual competence and compliance.

It said it provides cards for trade operatives, and also for people with supervisory and managerial responsibilities.

The scheme is also used by self-employed and agency workers, and those seeking employment in the sector.

The association also said it provides a suite of online health and safety training courses and tests.

How Sugarcrete turned sugarcane bagasse into four-hour fire resistance

Sugarcrete sets new EI 240 benchmark

The University of East London (UEL) has reported that its Sugarcrete® low-carbon building material has achieved an EI 240 fire resistance rating in full-scale testing in Spain, supporting its use in high-risk and safety-critical building applications.

According to UEL, Sugarcrete is formed from sugarcane by-product bagasse combined with sand-mineral binders and is intended as an alternative to conventional bricks and concrete blocks.

The university stated that the material has an estimated carbon footprint around six times smaller than traditional clay brick while maintaining performance in use.

Sugarcrete was developed at UEL’s Sustainability Research Institute, where researchers have focused on combining lower embodied carbon with stringent safety outcomes.

UEL indicated that fire performance has been a central element of the development programme in order to move the material into more demanding settings.

Full-scale AFITI test conditions and results

UEL reported that recent trials at AFITI Laboratories in Spain exposed Sugarcrete walls to one of the construction sector’s more demanding standardised fire resistance tests.

During the test, the internal face of the Sugarcrete wall was subjected to temperatures of 1,100°C inside the kiln chamber.

The external face of the wall reportedly remained at 26°C throughout the trial.

The test was run for 240 minutes, with UEL confirming that the wall maintained its integrity for the full four-hour duration.

Independent assessors concluded that the system achieved an EI 240 classification under EN 13501-2:2023.

The EI 240 rating indicates that the construction prevented fire penetration and limited heat transfer for at least 240 minutes.

UEL stated that this outcome places Sugarcrete among the highest-performing materials in current use for sustained fire resistance.

Performance compared with existing wall systems

According to the university, Sugarcrete’s performance in the AFITI test outstripped that of standard clay brick and concrete block walls assessed under comparable conditions.

The results were also reported to be in line with specialist fire-partition systems designed for higher-risk environments.

UEL said this brings Sugarcrete into the same category as systems currently specified for installations where extended fire resistance is required.

The university added that the testing focused on both structural integrity and thermal insulation across the four-hour exposure.

The material maintained stability while holding the temperature differential between the exposed and unexposed faces of the wall.

Potential use in safety-critical applications

On the basis of the AFITI trial and independent assessment, UEL stated that Sugarcrete is now a viable candidate for a range of safety-critical applications.

The university highlighted potential use in industrial fire walls designed to separate high-hazard areas within facilities.

It also identified protected escape routes as a key area where long-duration fire resistance and controlled heat transfer are required.

Further potential applications include data centres, where thermal protection and compartmentation form part of wider resilience strategies.

UEL added that petrochemical environments are another target sector, given their reliance on robust fire-rated separation systems.

Low-carbon profile alongside fire performance

UEL noted that Sugarcrete had already drawn attention for its lower embodied carbon profile before the latest fire tests.

The university presented the new data as evidence that reducing embodied carbon does not have to come at the expense of fire resistance or durability in use.

It said that the combination of lower carbon footprint and high fire performance could give construction clients another option when assessing materials for high-risk settings.

“To hold back fire at over 1,000 degrees for four hours proves Sugarcrete® is not only sustainable, but also safe and resilient enough for the most demanding environments.”
