Grenfell Tower Inquiry highlights failures in fire risk assessments

FPA, Senior Technical Consultant Howard Passey has commented on the crucial role of fire risk assessors (FRAs) in light of the Grenfell Tower Inquiry Phase 2 report.

The inquiry exposed serious shortcomings in fire risk assessments at Grenfell Tower, where assessors failed to identify critical hazards, including the flammable cladding, faulty fire doors, and inadequate evacuation plans for vulnerable residents.

Passey emphasised that these failures raise concerns about the entire profession: “The assessments carried out for Kensington and Chelsea Tenant Management Organisation (KCTMO) failed to identify critical fire hazards, such as the flammability of the external cladding system, inadequate fire door performance, and the lack of adequate evacuation strategies for vulnerable residents.”

He voiced support for the inquiry’s recommendation for a mandatory accreditation system to ensure fire risk assessors’ competence.

The need for better regulation of fire risk assessors

The inquiry report calls for a standardised, mandatory accreditation system to certify fire risk assessors.

Passey pointed out that despite years of industry efforts to introduce competency standards, the government had previously resisted prescriptive regulations.

However, after the Grenfell disaster, the push for stricter controls has gained momentum, with new legislation such as the Building Safety Act 2022 and updates to the Regulatory Reform (Fire Safety) Order 2005.

Passey stated: “Even before the devastating Grenfell Tower fire of 2017, the industry had made numerous efforts to engage government officials in designing regulatory requirements that would introduce ‘mandatory minimum standards of competence for training and accrediting fire risk assessors.’”

Developing competency standards for fire risk assessors

The fire safety industry has been actively working to improve fire risk assessor competency.

Organisations like the Fire Sector Federation (FSF) and the British Standards Institute (BSI) are developing a framework for assessing competency, which includes a tiered system for different building risks.

These efforts aim to ensure that fire risk assessors are properly trained and certified, particularly for high-risk buildings.

Passey explained: “The FSF has since, with BSI, been developing the framework into a British Standard as part of the BS 8670 Built Environment – Core criteria for building safety in competence frameworks.”

Concerns over fire risk assessors’ responsibilities and liability

Passey also raised concerns about the increasing responsibilities placed on fire risk assessors.

He questioned how much accountability should rest on individual assessors, especially given the complexity of modern buildings and the need for specialised knowledge in areas like fire engineering.

He noted that some tasks, such as assessing smoke control systems, might require input from a fire engineer rather than an FRA.

“There is an undue expectation that FRAs will be able to analyse the construction of an external wall, be an expert on the installation of fire doors, and even understand the individual needs of vulnerable residents when considering evacuation strategies,” Passey said, highlighting the need for clearer guidelines on the scope of an FRA’s responsibilities.

Document inspections and risk assessments, such as auditing fire doors on site can be conducted, and photographic evidence incorporated into evidence inspections done, so accurate asset registers can be maintained and validated.

The UK Home Office has published a report detailing the results of a survey conducted between July and September 2023, which aimed to understand the awareness and experiences of responsible persons (RPs) in response to recent changes in fire safety legislation in England.

The survey gathered data from 362 RPs, offering the first high-level description of the types of RPs in England, the buildings they manage, and their relationships with fire risk assessors (FRAs).

As reported by the Home Office, the findings indicate that RPs are largely aware of the Fire Safety (England) Regulations (FSER) and demonstrate a strong intention to implement the new regulatory requirements.

However, the report also highlights a need for RPs to improve their understanding of the legislative changes, particularly in terms of defining roles, competences, and training for both RPs and their FRAs.

Findings on compliance with fire safety regulations

The report suggests that the dissemination of fire safety information has been largely effective, with most RPs showing confidence in complying with FSER.

Areas such as fire door maintenance and the provision of fire safety instructions have been identified as well-handled by RPs, reflecting a commitment to upholding fire safety standards across various building types.

Nevertheless, the report notes that while RPs are aware of the regulations, there is still a need for better understanding, especially regarding the specification of roles and responsibilities.

This is seen as essential for ensuring that RPs and their fire risk assessors are adequately prepared to manage fire safety effectively.

Satisfaction levels among responsible persons with fire risk assessors

The survey results show variation in satisfaction levels among different RP groups when it comes to the quality of services provided by FRAs.

Sixty percent of RPs in the private sector and 69% in the public and third sectors expressed satisfaction with the services provided by FRAs.

However, RPs working with external FRAs reported higher satisfaction levels (71%) compared to those using in-house FRAs (48%).

These findings suggest that external FRAs may offer services that align more closely with the expectations and requirements of RPs.

The data could inform future initiatives to improve the quality and consistency of services across all sectors.

While the survey results indicate that RPs are adapting to new regulations such as Section 156 of the Building Safety Act (BSA), the report emphasises the importance of providing ongoing guidance and support.

Regulator of Social Housing fire safety report reveals remediation progress on buildings 11 metres and above

Regulator of Social Housing fourth quarterly report details fire safety remediation

The Regulator of Social Housing (RSH) has released findings from its fourth quarterly survey on fire safety for buildings over 11 metres in the social housing sector.

As reported by The Regulator of Social Housing, all social landlords are required to provide quarterly updates to RSH and the Ministry of Housing, Communities and Local Government on fire safety remediation efforts for the buildings they manage.

Out of 17,457 buildings reported, 99% had completed fire risk assessments.

Of these, 11% were found to have life-critical fire safety (LCFS) defects related to their external wall systems (EWS), while 88% showed no such defects.

11% of affected buildings are expected to have remedial work completed within the next six months, with 84% of repairs scheduled for completion in the next five years.

Landlords prioritise high-risk buildings

Some social landlords with multiple affected properties are prioritising fire safety remediation work on buildings considered higher risk.

These projects are often more complex and take longer to complete.

In the meantime, landlords are required to implement interim safety measures to protect tenants until all remediation work is fully finished.

The Regulator of Social Housing continues to monitor how landlords are progressing in their efforts to address LCFS defects.

Monitoring and regulation of fire safety

The RSH will continue its oversight of landlords’ fire safety practices, ensuring that systems and processes remain robust.

Social landlords must rely on accurate and up-to-date fire safety data to manage risks effectively and maintain tenant safety.

Will Perry, Director of Strategy at RSH, said: “This quarterly survey is an important tool in helping us monitor the progress being made by the sector on remediating fire safety defects.

“Fire safety is a fundamental responsibility, and we expect all landlords to take prompt and effective action so that tenants can feel safe in their homes.”

Landlords’ responsibilities towards tenants

Landlords are reminded of their duty to safeguard tenants’ safety while remediation work is being carried out.

Mitigating measures are required to reduce risk during the interim period, before repairs are fully completed.

Perry added: “Boards and councillors have a duty to ensure these plans are delivered.

“Meanwhile, our ongoing regulation, including our programme of inspections and responsive engagement, helps us check that landlords are meeting the outcomes of our standards – including those relating to fire safety.”

Adrian Hurley takes leadership of BESA for 2024-25

Adrian Hurley C. Eng has been elected as the President of the Building Engineering Services Association (BESA) for 2024-25, as reported by BESA.

Hurley is the managing director of FP Hurley & Sons, a contractor founded by his grandfather 75 years ago.

He has been an active member of BESA since 2019 and previously served as Vice President.

At BESA’s AGM, Hurley expressed his pride in leading the Association during its 120th anniversary year.

He highlighted BESA’s history and its role in providing leadership and expertise to help members navigate future growth opportunities.

Hurley emphasised: “The Association will once again provide leadership, guidance, and expertise to ensure members seize the opportunities for growth and diversification that are essential to the future of our businesses and the people we employ.”

Urgent need for building retrofits in the UK

During the BESA President’s Lunch, Hurley spoke about the importance of commercial building retrofits and called on the government to prioritise this work.

He noted that many of the UK’s 30 million buildings urgently require upgrades, particularly to support the country’s net zero goals.

Hurley said: “The deployment of new technologies, like heat pumps, is exciting and progressive, but there is so much we could still do to improve the performance of what is already built and installed.”

Hurley also warned that the large-scale retrofitting and refurbishment work could face delays due to a shortage of skilled workers.

He suggested that a combination of innovation, digital technology, and better recruitment practices would be needed to meet the demands of this task.

Increasing diversity and improving training in the building sector

Hurley raised concerns about the low number of women entering the building engineering sector and the trend of many leaving the industry before reaching their full potential.

He stressed that BESA is committed to improving training, attracting new talent, and providing opportunities for individuals already in the industry to enhance their skills.

“BESA is relentlessly pursuing ways to improve training and attract new talent,” said Hurley.

He also announced that BESA would be restructuring its training and skills services, aiming to better support members in proving their technical and professional competence and compliance with industry standards and legislation.

Commitment to the Building Safety Act following the Grenfell Inquiry

Following the publication of the final report from the Grenfell Tower disaster public inquiry, Hurley urged BESA members and the wider industry to fully commit to the Building Safety Act.

He described the Act as “groundbreaking legislation that goes far beyond safety into every aspect of our work.”

Hurley reminded members that the Grenfell Inquiry had been highly critical of the construction industry, highlighting many systemic failings.

He also stressed that building safety must not come at the expense of performance, arguing that buildings should provide both safety and comfort.

Hurley added: “Buildings need to be comfortable and have good indoor air quality.

“They need temperature control, and healthy levels of natural lighting and space.”
