How do you solve a problem like high rise building safety?

IFSJ looks at the UK government’s changes to the 2005 Fire Safety Order affecting high-rise buildings across England

Last month marked five years since the devastating fire that destroyed Grenfell Tower and claimed the lives of 72 of its residents. Following the disaster, the UK government launched the Grenfell Tower Inquiry Phase 1 in a bid to safeguard against history repeating itself.  Soon to be introduced under article 24 of the Regulatory Reform (Fire Safety) Order 2005 (Fire Safety Order), the government is implementing the majority of those recommendations triggering a change in the law set to come into force on 23 January 2023.

What happened

Following the Grenfell Tower Fire, the Government established in August 2017 the Independent Grenfell Tower Inquiry. The Inquiry published its first Phase report in October 2019. This report made several recommendations which the Government, in principle, accepted.

Following a call for evidence from the Home Office’s in response to the Independent Review of Building Regulations and Fire Safety, the Home Office launched the Fire Safety Consultation which ran from 20 July to 12 October 2020. Section 2 of the Consultation outlined the intention to lay regulations under article 24 of the Fire Safety Order to implement the Inquiry’s recommendations which required a change in the law. It also included proposals to implement the recommendations in a practical way.

The Government’s response to the Fire Safety Consultation was published on the 17 March 2021 and demonstrated broad support for these proposals. Following the commencement of the Fire Safety Act 2021, it was clarified that the Fire Safety Order applies to a buildings structure, external walls and any common parts of premises including all flat entrance doors for buildings containing two or more sets of domestic premises.

The regulations sit alongside the Building Safety Act amendments to the Fire Safety Order. The Government’s overhaul of supporting guidance issued under the Fire Safety Order aims to improve fire safety outcomes designed to protect the public from the risk of fire by better supporting compliance and effective enforcement in all regulated premises.

The new regulations

The Fire Safety Regulations 2022, which apply only to England will make it a requirement in law for responsible persons of high-rise blocks of flats to provide information to Fire and Rescue Services to assist them to plan and, where needed, provide an effective operational response.

In all multi-occupied residential buildings, the regulations require responsible persons to provide residents with fire safety instructions and information on the importance of fire doors. The regulations apply to existing buildings, and requirements for new buildings may be different.

On of the foremost requirements regards a premises’ secure information box which will become a legal requirement for all buildings that fall under the high-rise category. The regulations will require the responsible person to install a suitably secure information box in or on their high-rise building. They will also be required to provide in the box: their UK contact details, the UK contact details of any other person who has the facilities to and is permitted to access the building as the responsible person considers appropriate, copies of the building’s floor plans which identify specified key fire-fighting equipment. Their contents will be required to be kept up to date in line with the duties imposed by the regulations and the Fire Safety Order.

Responsible persons will also have to provide to their local Fire and Rescue Service information about the design and materials of a high-rise building’s external wall system and to inform them of any material changes to these walls. They will also be required to provide information in relation to the level of risk that the design and materials of the external wall structure gives rise to and any mitigating steps taken.

They must also legally provide their local Fire and Rescue Service with up-to-date electronic building floor plans and to place a hard copy of these plans, alongside a single page building plan which identifies key firefighting equipment, in a secure information box on site.

Monthly checks on the operation of lifts intended for use by firefighters and evacuation lifts in their building and check the functionality of other key pieces of firefighting equipment must be carried out. Any defective lifts or equipment must be reported to local Fire and Rescue Service as soon as possible after detection if the fault cannot be fixed within 24 hours. Records of the outcome of checks are to be made available to residents.

Whilst not a legal requirement under the new legislation, installing wayfinding signage has been recommended in all high-rise buildings to assist the Fire and Rescue Service in navigating their way round a building even when visibility is low.

Multi-occupied residential buildings in with two or more sets of domestic premises which have common parts must provide residents with fire safety instructions. Responsible persons should make sure that these instructions are shared with their residents in a form that residents can reasonably be expected to understand with instructions on: how to report a fire, a reminder of what the evacuation strategy is for that building, information on the importance of fire doors to a building’s fire safety and any other instruction that tells residents what they must do once a fire has occurred, based on the building’s evacuation strategy

In residential buildings with storeys over 11 metres in height, responsible persons will be required to undertake quarterly checks of all fire doors (including self-closing devices) in the common parts and undertake annual checks of all flat entrance doors, including self-closing devices, that lead onto a building’s common parts.

Personal Emergency Evacuation Plans

The Personal Emergency Evacuation Plans (PEEPs) in high-rise residential buildings consultation set out how the Government proposed to implement the two relevant Grenfell Tower Inquiry Phase 1 Report recommendations: that responsible persons of every high-rise residential building be required by law to prepare personal emergency evacuation plans (PEEPs) for all residents whose ability to self-evacuate may be compromised, and be required by law to include up-to-date information about persons with reduced mobility and their associated PEEPs in the premises information box.

The PEEPs consultation response revealed that a large majority of respondents supported the proposal to require the Responsible Person to prepare a PEEP for every resident who self-identifies to them as unable to self-evacuate and do so in consultation with the residents.

However, the consultation responses highlighted significant concerns over the proportionality, the practicality, and the fire safety case for PEEPs in all high-rise residential buildings. They found that whilst respondents were strongly in favour of any measures that improve the fire safety of residents who are unable to self-evacuate, there were serious concerns over increasing the risk of harm to those being evacuated.

There was also the issue of execution: If the PEEPs requirement were extended to all multi-occupied buildings, as advocated by some responses to the consultation, it would increase the number of buildings covered from around 12,000 buildings, to approximately 1.7 million in England.

The Government has since launched a new consultation, including a proposal on Emergency Evacuation Information Sharing (EEIS). The new proposal focuses on residential blocks of flats with a simultaneous evacuation strategy in place. In these buildings, responsible persons would be required to ask residents to make themselves known if they feel they might need support to evacuate in the event of a fire. The consultation will close on 10 August.

Who is liable?

The High Court in London delivered a landmark judgment that establishes legal liability for remedial safety work on buildings in a ruling that could help resolve one of the biggest unanswered questions from the Grenfell Tower fire. In the recent ruling, Essex-based contractor Mulalley & Co was ordered to pay damages towards the cost of removing cladding it had fitted to four residential tower blocks in Gosport on the south coast of England which had been deemed unsafe after the Grenfell blaze.

The ruling marks is the first time financial liability for remediation work on unsafe cladding has been established in court. It is thought that the outcome could have far-reaching ramifications for leaseholders, building owners and contractors in England.

Andy Hulme, chief executive of housing association Hyde Group which brought the claim via its subsidiary Martlet Homes against Mulalley, said the case had ‘massive implications for the market’. He said it should help unblock disputes between leaseholders living in blocks fitted with flammable cladding and the buildings’ owners over who should pay to have it removed.

“It’s the first time a contractor has been held accountable for the quality of work and the materials they have used,” he said. “Based on this case we now know where the lines of accountability lie.”

The court has yet to decide what the extent of the damages will be. According to reports Hyde is looking to recoup as much as much as possible of the £8 million it spent fixing the blocks. Criminal proceedings are expected to follow. Ahead of the inquiry laying out its conclusions, the High Court’s ruling could provide a legal precedent and a new path for leaseholders and property owners to recoup the costs of fixing blocks found to be unsafe in the aftermath of Grenfell.

Mary-Anne Bowring, a fire safety expert and group managing director at property consultant Ringley Group, said of the ruling is: “A landmark that gives hope to millions of residents living in unsafe buildings by opening the potential for legal action against other construction contractors who installed unsafe cladding”. She added, however, that: “It is not enough to simply expect developers and housing associations to launch further legal action off the back of today’s judgment in order to recover the money spent on fixing unsafe buildings.”

High-rise fires are not an issue confined to the UK – just look at the Bronx apartment Fire in January which claimed the lives of 17 people or Taiwan’s Kaohsiung tower fire last October which killed 46. Whilst the new Building Safety Act will hopefully resolve some of the issues in the UK, there is still a way to go before residents around the world can sleep easy knowing their homes are safe.

Former estate agent pleads guilty to fire safety breaches

Property management agent and retired Force and Sons estate agent Mr David Force, from Dawlish, has now pleaded guilty to three charges of breaches of fire safety at Newton Abbot Magistrates Court on Monday 15 August.

Force was ordered to pay full costs to the local authority. The charges relate to his property at 9 Queen Street, which is used as commercial businesses on the ground floor with a privately let flat above.

The Devon and Somerset Fire and Rescue Service said that this judgment demonstrated how the service acted as an enforcing authority by taking action to keep the public safe from harm.

The Investigation

In 2021, business safety officers from Devon and Somerset Fire and Rescue Service raised concerns with Mr Force for unsafe practices such as a lack of suitable means of escape in case of fire, structural failures and the absence of a fire risk assessment.

The officers took the decision that the premises were dangerous to the person who lived in the flat, and with immediate effect, they could not stay there anymore. This was due to the risk of a fire if occurring on the ground floor the person in the flat above would not be able to make their escape safely. The person in the flat was also considered to be vulnerable as they were elderly with additional disabilities.

Following the investigation, the fire service made the decision to take Force to court. The Service determined that the conditions found at the premises in 2021 were so far below an acceptable standard that they had put people at risk of death or serious injury in the event of a fire occurring. 

The investigation found that Force had known that the premises did not have adequate means of escape in case of fire back in 2009. He had never made an application for the works despite the need to do so. Despite this, he continued to take rent from a vulnerable person for a number of years despite knowing that the flat was unsafe to occupy.

The defendant pleaded guilty to all three charges from Regulatory Reform (Fire Safety) Order 2005 (FSO) including compartmentation, fire separation failures between the businesses and the flat, not having completed a fire risk assessment for the premises (Article 9), and failing to provide suitable means of escape in case of fire from the flat (Article 14).

The fines awarded were the maximum allowed under the sentencing rules. Force was ordered to pay the full prosecution costs of £8659.00 and a victim’s surcharge of £190.

After the prosecution, Glen Wells, Business Safety Legal Support Officer said: “Devon and Somerset Fire and Rescue Service take the safety of people who work, live and visit Devon and Somerset very seriously.

“Fire safety legislation is there for a reason, to ensure that people are safe in buildings should a fire occur and can safely evacuate should they need to do so.

“Where building owners provide accommodation, they must do so with all the required and appropriate fire safety measures in place.

“Where persons responsible for premises know that fire safety measures are poor and dangerous, or they knowingly allow poor fire safety standards, putting profits before safety, they will be held to account”.

All UAE University buildings now linked to Hassantuk Safety System

UAEU University has announced that all the buildings on all campuses are now connected to the Hassantuk safety system. The system is integrated with Civil Defense Command Centre in the UAE in line with an agreement with Injazat, the UAE’s leader in digital transformation. 

Hassantuk is a strategic public-private initiative between the UAE Ministry of Interior and Injazat designed to increase the efficiency of emergency services’ responses to all fire and life safety emergency alarms through a state-of-the-art smart system, helping to cut down response times and increase efficiency in all emergency events across the UAE, reducing the danger to life and damage to property. 

For the University, the Hassantuk system will send the alarm in real-time to the Command-and-Control Center, if smoke or fire is detected. The Center will then contact the UAEU Facilities Management (FM) team to check whether it is a real or a false alarm. The FM service provider will verify and repair the false alarm, but in case of a real fire, the Civil Defense team will arrive immediately.

The NFPA gears up for Campus Fire Safety Month

The annual “Campus Fire Safety for Students” campaign is set to launch this September as schools across the US return to in-person learning with the National Fire Protection Association (NFPA) and The Center for Campus Fire Safety (CCFS) working together to help ensure living spaces are as safe as possible for students.

Campus Fire Safety Month raises awareness about the threat of fires in both on and off-campus housing, highlighting relevant information to students, their parents, and campus housing staff and administrators who are encouraged to take proactive measures to protect themselves, their family, and peers from fires and make living spaces as safe as possible upon a student’s return to school.

According to data from CCFS, from January 2000 to April 2022, 94 fatal fires have been documented that occurred on a college campus, in Greek housing, or in off-campus housing within three miles of the campus and claimed 134 lives.

Of the 94 fires documented, 38 were accidental and involved cooking, candles, smoking, or electrical equipment, and took the lives of 51 students. NFPA research shows that September and October are the peak months for campus fires, particularly during the evening between 5:00 p.m. and 9:00 p.m.

Lorraine Carli, NFPA Vice president of Outreach and Advocacy and CCFS Advisory Council member, commented: “As students return to college life this fall, we encourage them to review fire safety tips to learn how to prevent fires. The more prepared we are, the more we can do to reduce fire risk.

She added: “Campus Fire Safety Month provides a great opportunity to share materials and action steps and foster a culture of awareness and preparedness about fire safety on our college campuses.”

Campus Fire Safety Tips

Know and practice the building’s evacuation plan, as well as alternate routes out of the building.

Cook in intended areas only, and never leave cooking equipment unattended when in use, even briefly.

Test smoke alarms monthly in an apartment or a house. Ensure smoke alarms are installed in all sleeping areas, outside of all sleeping areas, and on every level of the apartment or house. Never remove or disable smoke alarms.

Keep combustible items away from heat sources and never overload electrical outlets, extension cords, or power strips. Many fires are caused by portable light and heat sources, like space heaters and halogen lamps.

Keep common areas and hallways free of possessions and debris. Never block exit routes.

Nigerian Society of Engineers embarks on fire safety campaign

The Victoria Island branch of The Nigerian Society of Engineers has begun a week-log engineering programme that aims to increase community awareness on digital technology skills and fire safety.

The chairman of the branch, Engr. Emeka Benson Ibeh, told a press conference that the essence of this gathering is to intimate the public about our engineering week.

Ibeh said the purpose of the week is to give back to the community in terms of skill digital awareness, educate them on what the society does and also to focus on the theme of this year’s engineering week, which is on communication and digital economy the role of engineers.

The five days of activity will include a public lecture in honour of the branch’s immediate past president, Engr. Babagana Muhammed, a Fellow of the Nigerian Society of Engineers, as well an induction of 59 new corporate members.

The branch has also organised a free digital skills acquisition training for its young engineers and SMEs interested to participate as a way of giving back to the community.

Thursday will see the AGM and election, bringing a new executive committee on board to govern the branch for the next year. Finally, friday will see a market fire safety campaign on how to prevent fire outbreaks with the use of basic fire safety techniques augmented with digital solutions.

On this year’s theme, “Advancing the Frontiers of Communication and Digital Economy in Nigeria: The role of the Nigerian Engineer”, Ibeh said: “The reality in doing business not just in Lagos, Nigeria but the world at large is now transiting from analogue to digitalisation influenced by the internet, new technologies such as blockchain and other digital solutions, and it has come to stay with us. The earlier we embrace it, the better for all of us”.

Staffordshire fire issues safety warning following tumble dryer fire

Staffordshire Fire and Rescue Service has urged the public to check their home appliances following a tumble dryer fire in Newcastle-under-Lyme.

Crews from Hanley and Newcastle attended an address off Mount Pleasant, at 12.50am on Monday (22 August) morning.

On arrival, crews found a tumble dryer on fire. The fire was extinguished using two breathing apparatus and one hose reel. A man, in his 50s, was treated at the scene for smoke inhalation. The cause of the fire was deemed to be accidental. Crews left the scene just before 2.20am.

Andrew Bourne, Station Manager at Staffordshire Fire and Rescue Service, said: “Overloaded sockets and faulty electrical appliances cause over 7,000 house fires in Staffordshire every year. We urge residents to ensure they are aware of the risks associated with electrical appliances and make sure they adhere to the guidelines.

“It is always best practice to ensure your electrics have a British or European safety mark and to ensure plug sockets or extension leads are not overloaded.

“High powered machines such as tumble-dryers should be kept to a single socket to avoid overheating. They should not be left unattended and should be unplugged when not in use.”

Panel formed to enforce fire safety norms for vulnerable buildings in Maharashtra

The Maharashtra government has informed the Bombay High Court Monday that it has issued a government resolution to set up a four-member committee to enforce fire safety norms for vulnerable buildings.

Led by former Brihanmumbai Municipal Corporation commissioner Pravin Pardeshi, the committee will prepare a report with recommendations for implementation of draft regulations for fire safety in buildings vulnerable to man-made disasters.

The regulations were established in 2009 in the aftermath of the 26/11 terror attack, which took place in 2008. The court directed the panel to submit its report with recommendations in two months.

The panel will submit a report in consultation with the concerned experts in the field. “The draft rules are of 2009. We are now in 2022. The committee shall see if we need to improve the rules and our system,” the court said last month.

This week, government pleader Hiten Venegaonkar told the bench that the proposal was approved by the state government, which issued a GR in that regard on August 18 with eight terms of reference for the panel to deliberate upon. The court also asked the panel to give a personal hearing to the petitioner to give her suggestions for its consideration.

The bench said that final recommendations of the panel shall be placed before the state government as soon as they are prepared and same shall be placed before the court on October 20, when the PIL shall be listed next for further consideration.

Insurance firm predicts rise in lithium-ion fires from e-bikes and scooters

Insurance firm AXA UK has issued a warning over the growing fire risks associated with the lithium-ion batteries used in increasingly popular electric bikes and scooters. Lithium-ion batteries pose a significant fire risk when damaged, over-charged or exposed to extreme temperatures.

Over the past two months, AXA has reportedly covered almost half a million pounds of losses on two large claims caused by lithium battery fires.

The firm said that it anticipates the frequency and cost of these fires will grow exponentially as transport via e-bikes and e-scooters becomes more popular. AXA’s claims data show that these fires most frequently occur within residential buildings.

One of the recent large claims was the result of a faulty e-scooter battery which was being charged in the kitchen of a ground floor terrace flat which caused an explosion and fire to spread through the home, reaching two storeys above.

The second occurred in a block of flats where an e-bike battery was being charged. The fire destroyed the flat and caused smoke damage to the flats on either side.

Dougie Barnett, Director of Customer Risk Management at AXA Commercial, commented: “Fire safety should be the top priority when it comes to charging and storing electric bikes and scooters. These forms of transport are becoming increasingly common due to the range of benefits they provide, however, this makes it even more essential that people understand the risks around storing them in the wrong way or using damaged batteries.

“As an insurer, we’re there for people when the worst happens, but we want to make sure these risks are managed and reduced so they can avoid the devastating consequences of a fire in their homes or business.”

A spokesperson from London Fire Brigade commented: “It’s incredibly concerning that we are continuing to see a rise in incidents involving e-bikes and e-scooters. When these batteries and chargers fail, they do so with ferocity and because the fires develop so rapidly the situation can quickly become incredibly serious.

“Our advice is to try and store and charge e-bikes and e-scooters in a safe location if possible, such as in a shed or garage, and if they have to be stored inside, make sure there is smoke detection fitted and your means of escape is not obstructed. However, we know this won’t be possible for everyone, so if you are charging them indoors, please follow our advice on using safe charging and ensure everyone in your home knows what to do in the event of a fire.”

To reduce the risk of lithium battery fires, AXA recommends:

  • Never leave batteries charging in a building that is unattended or overnight when you are sleeping in the property
  • Unplug or disconnect from the battery once charging is complete
  • Do not allow the battery to overheat and ensure it is charged on a hard surface where heat can disperse
  • Monitor and assess for damage to the battery and the charger, following the manufacturer’s guidance for replacement or repairs
  • Ensure smoke alarms – preferably interlinked detectors around the property – are fitted where charging is taking place and, if possible, store and charge away from main living

New South Wales enhances public safety network with Motorola Solutions

NSW Telco Authority has awarded Motorola Solutions a five-year contract extension to support and enhance the state’s Public Safety Network (PSN).

The AUD $60 million contract, which includes estimates for future costs, will provide secure and reliable voice and data communication to keep first responders across the state connected at all times.

NSW Telco Authority described PSN as the most important critical communications network in New South Wales next to Australia’s triple zero emergency hotline as spanning 324,000 square kilometres, it is one of the largest emergency communications networks of its type in the world.

The network will provide instant, team-based communication for more than 50 public safety agencies and over 50,000 radio users across emergency services, essential services, government agencies and local councils.

Motorola Solutions has provided New South Wales’ agencies with vital communications in the face of many major emergencies, supporting rescue and emergency efforts during the recent devastating floods, the Black Summer bushfires of 2019/20 and other natural disasters.

It will deliver a comprehensive suite of public safety services for PSN, including network lifecycle upgrades and 24/7 cybersecurity, helping to keep this mission-critical technology up-to-date, secure and performing reliably in any situation.

Software upgrades will provide further advancements to the network’s location, vehicle and personnel protection capabilities. The upgrades will also provide NSW Telco Authority with the flexibility to implement next-generation technologies over time. This includes software to extend the reach of interoperable land mobile radio (LMR) communications to more users via cellular networks as well as the introduction of converged communication devices.
