UK growth in data centres drives building services shift

The Building Engineering Services Association (BESA) has reported that building services contractors are increasingly taking the lead in UK data centre projects.

According to BESA, this shift is supported by new industry data and discussion at a roundtable event held in Manchester.

The Association said that UK data centre development has grown substantially in the last five years, with the rise of artificial intelligence (AI) expected to drive further growth.

The Barbour ABI market research group confirmed that data centres were the “boom segment of 2024,” noting a sharp rise in planning application values from £1.3 billion in 2023 to £2.6 billion.

BESA projects the UK market could reach £1.1 trillion by 2030, up from £2.3 billion today.

Building engineering firms take lead contractor role

According to the latest edition of BESA’s Top 30 Contractors report, data centres, along with pharmaceutical and defence facilities, are continuing to grow despite wider economic uncertainty.

The report states that in many of these projects, building services represent over 60% of the total project cost.

This makes mechanical, electrical and plumbing (MEP) firms the de facto lead contractors in an increasing number of cases.

At the BESA roundtable, technical director Kevin Morrissey said: “The pace of growth provides significant opportunities for companies to scale up and diversify.

“However, the pace of growth is putting pressure on supply chains and our members are facing significant resource constraints in these high demand sectors.

“We also need to be mindful of the impact of rapid development on the environment and natural resources, particularly energy and water consumption.

“Sustainability must be considered in every project. One key issue is how we use waste heat from data centres in heat pumps and district heating networks.”

Off-site fabrication and quality control in data centres

The roundtable, chaired by Remi Suzan, managing director of Gratte Brothers Ltd, discussed the role of off-site fabrication in addressing workforce shortages and improving efficiency.

Suzan said: “The discussions at this week’s BESA roundtable underscored the critical role that our industry plays in the data centre sector.

“We are helping to drive innovation, sustainability, and resilience in our digital economy.

“As the industry continues to evolve, collaboration and forward-thinking strategies will be key to ensuring we meet growing demands efficiently and responsibly.”

Andy Harrop from Armstrong Fluid Technology noted that off-site methods also contribute to improved quality control.

He explained that this is particularly important in data centre projects, where precision and consistent performance are key requirements.

However, participants also pointed out that off-site fabrication requires higher upfront investment and careful planning.

Geographic concentration and infrastructure pressure

Barbour ABI’s head of analytics Ed Griffiths told attendees that the south east of England and London remain key areas for data centre construction.

He said this is due to their proximity to undersea cables and energy infrastructure.

Griffiths added that these regions are reaching capacity, which will prompt expansion in other parts of the UK.

He stated that ongoing government infrastructure priorities will likely support this trend, but added that planning departments will face increased workload as demand grows.

Addressing skills gaps in the data centre sector

BESA’s head of skills and policy Stuart Rattray said the Association is investing in long-term workforce development to support industry growth.

Rattray said the BESA Academy is focused on building awareness, developing apprenticeship opportunities, and aligning training with employer needs.

He explained that attracting younger workers and managing an ageing workforce were among the key challenges.

Rattray added that BESA is also involved in setting National Occupational Standards and designing sector-specific competency frameworks for data centre-related roles.

He said these efforts are necessary to ensure the industry is equipped to meet the growing demand for skilled professionals.

Other certified products include LST sealants, PipeBloc PWP wraps and collars, NS Putty Pads, PenoPatch, Flexi-Coat, Silverseal compounds, S-Line Pillows, PS Coating and Paraflam cavity barriers.

These systems are designed to reinstate fire compartmentation where gaps or penetrations exist in walls, floors and ceilings.

They are typically used to seal joints, cable routes, pipes and electrical socket areas.

FSi Promat noted that its manufacturing site in Measham continues to supply these products for use across UK building projects.

Thousands of high-rise residents left unprotected by missing fire safety plans

One-third of required plans still missing across England

New analysis by FASTSIGNS has reported that many high-rise buildings in England are still not meeting legal requirements under fire safety regulations, with a third of key documentation still outstanding.

According to data sourced by FASTSIGNS from 24 fire and rescue services through Freedom of Information requests, an average of 32 per cent of building plans and 31 per cent of external wall plans for high-rise residential buildings remain unsubmitted.

These documents are required under the Fire Safety (England) Regulations 2022, which came into force on 23 January 2023 following the Grenfell Tower fire in 2017.

The regulation mandates that responsible persons for high-rise residential buildings of 7 storeys or more must provide up-to-date building and external wall plans to their local fire service.

FASTSIGNS stated that the lack of these plans limits fire services’ ability to prepare for emergencies and obstructs residents’ access to clear exit signage during incidents.

Regional differences in plan submissions

Staffordshire Fire and Rescue Service recorded the highest submission rates, receiving 157 per cent of required building plans and 164 per cent of wall plans for its 42 high-rise buildings.

According to FASTSIGNS, Lancashire Fire and Rescue Service ranked second, reporting submission rates of 108 per cent for building plans and 118 per cent for wall plans.

Oxfordshire, Derbyshire, North Yorkshire and Shropshire all reported 100 per cent submissions across both categories.

In contrast, Avon Fire and Rescue Service reported the lowest building plan submissions at just 10 per cent across its 239 high-rise buildings.

Bedfordshire Fire and Rescue Service received the lowest number of wall plans, with only 22 per cent submitted for its 65 qualifying buildings.

FASTSIGNS stated that the national average across the 24 services surveyed stood at 68 per cent for building plans and 69 per cent for external wall plans.

Fire safety regulation introduced following Grenfell Tower fire

The regulation requiring up-to-date signage and safety documentation was introduced following recommendations made in the aftermath of the Grenfell Tower tragedy in July 2017.

“Our latest research shows that while progress is being made, there are still some challenges to overcome.

“For example, on average, around a third of building plans remain incomplete and audit frequencies can be inconsistent.

“While it’s encouraging to see increased focus on regular, defined checks before and during the construction of high-rise residential buildings, it’s equally important to ensure these checks continue throughout the building’s lifespan.

“We’re continuing to work closely with our customers across England, ensuring that buildings meet the evolving fire safety requirements to safeguard everyone involved.”

Audit and inspection practices vary across fire services

FASTSIGNS also reported that 50 per cent of fire services surveyed confirmed they conduct audits of high-rise buildings, though timeframes and approaches varied.

The company stated that some services conduct annual inspections, while others work on a rolling four-year cycle or base their audits on local risk assessments.

According to the research, there is no consistent national standard for inspection frequency, with practices differing between fire authorities.

Some fire services referenced the use of national guidance to determine inspection schedules, while others described localised or reactive methods.

FASTSIGNSconcluded that the variability in audit procedures could affect how effectively fire safety is maintained over time in different regions.

Industry response calls for improved training

Nicola John, managing director of FDM (Fire Door Maintenance) – Training and Development, commented on the findings of the research.

John said: “This research highlights just how much work still needs to be done to ensure our high-rise buildings are truly safe.

“At FDM – Training and Development, we believe safeguarding lives starts with empowering those responsible, which is why we deliver training for the industry, by the industry, across every level of the supply chain.

“Everyone involved, from manufacturers and installers, to responsible persons, needs the knowledge and confidence to meet their legal duties and protect the people living in these buildings.”

Incomplete fire safety plans hinder UK fire services: Summary

The panel said it will assess how the building control system can help the government meet its aim to deliver 1.5 million new safe homes during this Parliament and beyond.

It will evaluate how proposals for a Single Construction Regulator and a Chief Construction Adviser could support a reformed building control function.

It will also explore how building control could be delivered collaboratively across combined local authorities in support of England’s devolution agenda, as outlined in the English Devolution White Paper.

According to the panel, opportunities for efficiency through data, digitisation and shared services will be examined in relation to oversight by local authorities and the BSR.

Key interdependencies and workforce issues under review

The panel will consider interdependencies with other building safety policy priorities already identified by MHCLG and the BSR.

It will examine building control workforce competence and capacity, performance concerns across both local authority and private sector providers, and the effectiveness of current regulatory protections.

The review will also assess the impact of any new requirements on current training and recruitment systems.

Additional interdependencies include proposed updates to the technical Parts of the Building Regulations, how warranty schemes relate to control systems, and whether reforms to the 2010 Building Regulations and Charges Regulations are needed.

Information sharing between building control bodies and the BSR or government will be reviewed as part of wider data reform.

Membership, working model and reporting schedule set

Supply chain collaboration helps meet legislation requirements

Early cooperation between suppliers and partners is improving industry response to new legal duties in the United Kingdom.

AEI Cables has reported that increased engagement across the construction supply chain is helping stakeholders meet the requirements of the Building Safety Act 2022.

The legislation applies to high-risk buildings in England, defined as those over 18 metres tall or with seven or more storeys containing at least two residential units.

AEI Cables general manager Stuart Dover said: “We believe in early collaboration on our own projects and the feedback we are receiving suggests that close working between all parties in the supply chain is helping to meet the requirements of this new legislation.”

The company said that this approach is receiving positive responses from industry professionals, particularly in relation to complex safety documentation requirements.

The role of the Building Safety Act and regulator

The Building Safety Act 2022 introduces new responsibilities for the design, construction and occupation of high-rise buildings.

According to AEI Cables, the Act includes a ‘Golden Thread’ requirement, meaning that accurate and accessible safety information must be kept for the full life of a building.

This includes information relevant to fire and structural safety, and must be accessible to the people who need it.

The Act also creates a new Building Safety Regulator, which will oversee building safety and performance in England.

The regulator will focus on high-rise residential buildings and will have responsibility for improving competence among building control officers, tradespeople and other professionals.

The company added that the regulator’s remit is to promote organisational capability across the sector.

Cable standards and fire performance categories

AEI Cables has been providing guidance on the use of Category 3 Control fire performance cables, in line with the revised British Standard BS 8519:2020.

These cables are designed to maintain circuit integrity during fire and limit the spread of smoke and toxic gases.

According to AEI Cables, systems powered by these cables include smoke and heat extraction, which support safe evacuation and assist fire and rescue services during operations.

The company stated that this applies particularly to systems such as emergency voice communications, evacuation alarms for disabled people, and voice alarm systems in high-occupancy buildings.

Relevant premises listed in the guidance include hospitals, tall buildings, shopping centres, office developments and sports venues.

Approval and certification for high-performance cables

AEI Cables said its Firetec Enhanced range is approved to both Category 2 and Category 3 Control as defined in Annex B of BS 8519.

This approval has been granted by LPCB, an independent certification body for fire safety products.

BS 8519 outlines six cable categories based on performance: three for power and three for control, each with specific survival times of 30, 60 or 120 minutes.

The company noted that this classification helps ensure appropriate cable selection based on building use and risk.

AEI Cables said its products undergo assessment by other independent bodies including BASEC.

International and UK-specific approvals

In addition to domestic certification, AEI Cables confirmed that its products hold approvals from several UK and international bodies.

The company cited Lloyds, the Ministry of Defence, Network Rail and London Underground among those who have certified its products.

It also said that all of its cable ranges are manufactured in line with international standards.

According to AEI Cables, these standards support the supply of specialist fire performance cables to projects around the world.

Can you start by telling us about your role at Quelfire and how it connects with early-stage project design?

As Technical Client Relations Manager at Quelfire, my role sits within the technical team and focuses on direct engagement with clients and design teams.

My role involves direct interaction with customers and clients, assisting with daily technical queries and, more importantly, engaging early in project development.

Quelfire offers complimentary technical support to design teams at the project’s inception, helping them design buildings that incorporate available tested solutions.

This early engagement includes initial meetings with the design team to discuss processes, advise on the information we require and explain what we can provide in return.

Once we’ve identified specific details applicable to the project, I remain available for further meetings to address queries, advise on incorporating these details into the design and provide ongoing support.

What kinds of firestopping challenges do you see when you’re brought into projects early and how do these differ when engagement happens too late?

When we’re involved early, we generally don’t encounter significant challenges.

Even if specific information isn’t available at the outset, we can work with established principles that pave the way for identifying and applying tested details later.

There’s no stage that’s too early for our involvement.

Conversely, late engagement presents considerable challenges.

If the building design is finalised without considering firestopping of services, applying tested solutions becomes difficult.

For instance, if wall and floor constructions, ceiling heights and opening sizes are already determined with minimal opportunity for adjustment, it may be challenging or even impossible to apply a tested detail.

This situation forces the project team to either proceed without compliance or rework the design, both of which are avoidable with earlier consideration of firestopping.

Why do you think fire safety is still being pushed down the design timeline, despite the risks and regulations in place?

A major factor is the lack of priority given to detailed design at early stages.

For firestopping to be addressed properly, you need coordination across disciplines – MEP, structural, architectural – and that often isn’t built into the early project scope.

It’s not that people don’t care about fire safety.

It’s just that it hasn’t been budgeted for or included in the initial programme.

Clients often don’t allocate enough resources and time to the early design phase.

This lack of allocation means that MEP designers and architects can’t dedicate sufficient manpower and time to delve into the details and identify necessary elements.

To prevent fire safety from being sidelined, more resources need to be allocated to the early stages of design.

What does early engagement actually involve in practice and who needs to be part of that conversation from the start?

Early engagement involves designing the building around available tested solutions.

This means ensuring that all systems – substrates, MEP services and others – have corresponding test evidence.

Builders’ work openings, ceiling heights and similar elements must be appropriately sized and set out to allow for the application of tested solutions.

Equally important is ensuring that these designs are practical to implement on-site.

The conversation should include everyone in the design team: architects, MEP designers, structural designers and others.

Additionally, input from manufacturers of all involved systems is crucial – this includes firestopping product manufacturers like us, MEP service system manufacturers, wall or floor system manufacturers, damper manufacturers and more.

The BSR has said most Gateway 2 applications are still being rejected – what’s going wrong?

The BSR expects applicants to present their designs confidently, demonstrating understanding and providing clear justifications.

To improve submission quality, a detailed schedule of firestopping throughout the project is necessary.

This includes clarity on each firestop, the tested details applied and the supporting test evidence.

Designing buildings around tested solutions and clearly scheduling these specifics can significantly enhance the quality of firestopping design.

Providing demonstrable evidence for each proposed solution makes the submission more robust and less open to dispute.

WhatsApp messages create binding construction contract, UK High Court rules

Court rules UK case confirms WhatsApp message created valid agreement

The Building Engineering Services Association (BESA) has reported that a UK court has ruled an exchange of WhatsApp messages was sufficient to form a legally binding construction contract.

The Technology and Construction Court delivered its judgement in Jaevee Homes Limited v Mr Steve Fincham (trading as Fincham Demolition) [2025] EWHC 942 (TCC), confirming that informal digital communications can establish contractual relationships if they include the required elements of contract law.

According to BESA, this ruling reaffirms existing principles but signals the increasing importance of clarity when using informal channels like messaging apps in construction projects.

The judgement follows a dispute between Norfolk-based developers Jaevee Homes and Fincham Demolition over demolition work at a former nightclub in Norwich, which commenced without a signed contract but was preceded by a WhatsApp exchange confirming the job.

The ruling upheld an adjudicator’s earlier decision, confirming that the informal messages constituted a valid agreement and that the payment claims submitted afterward were enforceable under that contract.

Background of the demolition dispute in Norwich

BESA outlined that Jaevee Homes initially approached Fincham Demolition in early 2023 for work on a redevelopment project in Norwich.

Following discussions by email regarding pricing and scope, Fincham sent a quotation, but no formal contract was signed.

The decisive interaction occurred on 17 May 2023, when Fincham sent a message via WhatsApp asking: “Are we saying it’s my job mate so I can start getting organised mate.” Ben James of Jaevee Homes responded: “Yes.”

Although Jaevee Homes subsequently issued a written subcontract and purchase order, these documents were not signed or acknowledged by Fincham.

As demolition works progressed, the working relationship broke down.

Fincham submitted four payment applications in June, which Jaevee Homes argued were invalid under their interpretation of a monthly payment agreement.

Jaevee insisted the unsigned subcontract governed the relationship, while Fincham maintained that the agreement was based on the WhatsApp messages.

Court confirms contract was formed via WhatsApp

The High Court found that the WhatsApp messages included the core elements needed to create a contract.

According to the judgement, these included offer and acceptance, consideration (payment), intention to form legal relations and sufficient certainty in terms.

BESA reported that the court placed emphasis on the clarity of the initial WhatsApp exchange.

It stated that the absence of formal documents or a signature did not prevent the creation of a legally binding construction contract.

This was because the communications demonstrated agreement on scope, price and the parties’ intentions to proceed.

The court also upheld that the invoices submitted by Fincham were valid payment notices under the contract formed on 17 May 2023.

Implications for digital communication in construction contracting

BESA advised its members that the ruling is a reminder of the legal risks associated with informal communications.

While the use of digital platforms such as WhatsApp, SMS or email is common in commercial settings, these channels can unintentionally formalise agreements if care is not taken.

The association stated that even brief, casual conversations may bind businesses to contractual terms if they include key contractual elements.

It noted that contractors should follow up informal messages with a written document that clearly outlines the agreement and overrides previous communications where necessary.

BESA warned that other emerging risks – including the use of disappearing messages, voice notes or AI-generated texts – may also carry legal consequences, depending on how courts interpret these formats.

Legal guidance from BESA for construction businesses

BESA has issued practical guidance to support its members in navigating this issue.

The association recommends that construction businesses document agreements in writing after any informal negotiation.

It also advised firms to review how digital platforms are used internally and externally, and to consider setting policies that clarify acceptable channels for key project communications.

Grenfell Inquiry progress report June 2025: UK Government update

Government confirms 57 of 58 Grenfell recommendations are in progress

The UK Government has released its first quarterly report outlining progress on the 58 Phase 2 recommendations issued by the Grenfell Tower Inquiry.

According to the update, published on 29 May 2025, 57 recommendations are currently in progress, with one already completed.

The UK Government stated that it accepted all recommendations and remains committed to implementing each of them in full.

Implementation is expected to take at least four years due to the need for legislative changes and consultations.

Quarterly updates will continue until all recommendations are marked as complete.

Timetable for implementation and future reports

The UK Government explained that the timeline for full delivery will be set out in a later progress report scheduled for September 2025.

The government stated that some recommendations, such as those involving administrative changes, will be implemented within months.

Others, especially those requiring consultation or primary legislation, will take longer.

Reports will be published in February, May, September and December each year.

Each report will follow a consistent structure and provide status updates for every recommendation.

Government groups recommendations into four key themes

The UK Government’s report groups the Grenfell Tower Inquiry Phase 2 recommendations into four themes:

The government has enacted a machinery of government change to consolidate fire and building safety oversight.

From 1 April 2025, fire responsibilities have transferred from the Home Office to the Ministry of Housing, Communities and Local Government (MHCLG).

The change aims to align housing and fire safety under a single Secretary of State.

Minister Alex Norris is now responsible for fire and building safety.

The government confirmed that officials remain in the Home Office during the transition but report to the Deputy Prime Minister.

Work on the full transfer will continue through 2025.

Health and Safety Executive examines gas valve access issues

The Health and Safety Executive (HSE) has been reviewing access to pipeline isolation valves, as raised in the Grenfell recommendations.

It gathered evidence from gas network operators and has developed initial options for resolving access and inspection challenges.

The HSE said its focus includes improving awareness among building owners and landowners on the importance of pipeline valve accessibility.

Work is ongoing to refine these options.

NFCC leads fire and rescue services progress

The National Fire Chiefs Council (NFCC) is coordinating work to address all 13 fire and rescue recommendations.

In April, the NFCC submitted an action and delivery plan to government.

To inform the plan, NFCC surveyed UK fire and rescue services to assess current capability.

The organisation is now analysing the responses to identify areas where support or improvement is needed.

The plan will be shared with key stakeholders by the end of May 2025.

National resilience strategy and UK Resilience Academy

The government is working to enhance emergency preparedness across national and local levels.

The Cabinet Office is conducting a review to assess current resilience strategies and identify areas for change.

One of the measures already launched is the UK Resilience Academy, which began operation in April 2025.

The academy will train over 4,000 individuals each year using National Occupational Standards.

It aims to improve consistency and quality in resilience training for emergency roles.

Risk Vulnerability Tool offers real-time data for crisis planning

To support emergency response planning, the National Situation Centre and Office for National Statistics have launched a Risk Vulnerability Tool.

The tool uses near real-time data to identify communities and individuals who may be disproportionately impacted in emergencies.

It is available to UK and devolved government officials and provides data on demographics and specific hazards like weather or power outages.

Revised guidance has also been issued to help local responders identify and support at-risk individuals during a crisis.

New emergency response guidance published

The Cabinet Office has published the updated “Amber Book – Managing crises in central government”.

This replaces the previous Central Government Concept of Operations for Emergency Response and Recovery.

The Amber Book includes new material on the human aspects of emergency response and emphasises humanitarian needs during crises.

The updated guidance forms part of the government’s broader effort to modernise national emergency planning frameworks.

Residential PEEPs to become mandatory for high-rise buildings

The government confirmed that it will introduce secondary legislation mandating Residential Personal Emergency Evacuation Plans (PEEPs).

These will apply to all high-rise residential buildings and medium-rise buildings using simultaneous evacuation strategies.

PEEPs will require building owners or managers to engage with vulnerable residents, share fire procedures, and provide evacuation support information to fire and rescue services.

The legislation is expected to be laid before Parliament by the end of June 2025, subject to scheduling.

Funding committed to support PEEPs rollout

The UK Government has allocated funding for 2025/26 to assist social housing providers in delivering PEEPs.

It said future funding decisions will be made in the upcoming Spending Review.

Guidance on PEEPs will be developed following the legislation, with input from disability advocacy groups.

A toolkit will also be produced to assist responsible persons with implementation.

Inquiry transparency measures to be introduced

The UK Government accepted the Inquiry’s recommendation to improve monitoring and transparency around public inquiry implementation.

A new register will be launched on GOV.UK by summer 2025 to track all recommendations issued by public inquiries since 2024.

This will include recommendations from coroners, select committees and inquiries such as the Infected Blood Inquiry.

The register will be updated regularly and serve as a long-term monitoring tool.

Parliamentary scrutiny of inquiry progress ongoing

The government acknowledged that Parliament is responsible for its own scrutiny of inquiry recommendation implementation.

It confirmed it will continue to support Parliament in holding government departments to account.

The Cabinet Office is leading a wider piece of work on inquiry reform.

This aims to improve how wrongs are identified, responses are tracked, and recommendations are implemented.

The reform process is still at an early stage, but future updates will be provided.
