MEP sector compliance under review in new building safety survey

The Building Engineering Services Association (BESA) has announced new research into how UK firms are responding to the current building safety regime.

The research is being carried out with construction analysts Barbour ABI.

BESA said the aim is to evaluate levels of compliance across the mechanical, electrical and plumbing (MEP) sector under the Building Safety Act.

The news follows changes announced by the UK Government, which removed enforcement responsibility from the Health and Safety Executive (HSE).

According to BESA, this is the second annual building safety survey targeting organisations of all sizes.

The organisation said it will assess levels of legal understanding, individual competence, and organisational capability across the MEP supply chain.

Fast-track measures follow planning delays and low approvals

BESA stated the research comes at a time of policy changes and growing urgency around planning approvals.

According to BESA, delays and a shortage of assessors prompted the Ministry of Housing, Communities and Local Government (MHCLG) to introduce a fast-track scheme.

The new scheme is being led by two former senior fire officers.

A Freedom of Information request submitted by cost consultant Cast revealed that only 10.8 percent of Gateway 2 project applications had been approved.

The association said these low figures had raised concern among industry bodies and highlighted the practical challenges of meeting planning regulations.

BESA also pointed to renewed public scrutiny following the release of the Netflix documentary Grenfell: Uncovered, which revisited the causes and consequences of the Grenfell Tower fire.

Survey aims to identify barriers to compliance

Rachel Davidson, BESA’s director of specialist knowledge, said the survey aims to uncover obstacles to legal compliance.

Davidson said: “We want to find out what is preventing organisations from adopting the requirements of the legislation.”

She added: “Levels of awareness and understanding of the Act have improved in the past 12 months, but it is a far from consistent picture.”

She continued: “We are seeing very big variations by role and type of organisation.”

She said: “Those with greater understanding, particularly of individual competence and organisational capability, are more likely to have taken steps to comply with the Act.”

BESA said the survey will explore role-specific awareness, track behavioural change, and examine why some organisations have not adapted their practices.

According to Davidson, lack of support remains a key issue: “Where action has not been taken, it is often due to a lack of clarity, guidance, or support.”

She added: “Identifying these barriers will inform targeted interventions to improve industry-wide compliance.”

Industry Competence Committee input included

BESA stated the new survey includes input from Jon Vanstone, chair of the Industry Competence Committee (ICC).

The ICC advises the Building Safety Regulator on matters relating to individual and organisational competence.

Vanstone said: “BESA’s research comes at an important time because pressure is building to get more projects through planning gateways.”

He added: “However, this also raises the stakes around competence and compliance because the industry will still need to meet rigorous safety standards as workloads increase.”

He continued: “Therefore, any findings that help us understand why companies might be struggling to meet the requirements will be incredibly helpful in shaping our advice to the regulator.”

BESA said the inclusion of ICC questions will help shape guidance and education efforts for the wider sector.

Legislative intent remains a central focus

The UK Government has pledged to hire 100 new planning specialists to reduce project delays.

According to BESA, this is linked to the Government’s goal of delivering 1.5 million homes during the current parliamentary term.

Alex Norris, Minister for Building Safety, said: “We’re enhancing operations, reducing delays, and unlocking the homes this country desperately needs – while keeping safety front and centre.”

BESA chief executive officer David Frise said the sector must remember the reason the legislation was created.

Frise said: “The Netflix documentary was a timely reminder to anyone involved in a building project that every decision they make has a consequence.”

He added: “If you are making a change to a design (possibly for very valid reasons) what impact will that have, ultimately, on the people who inhabit that building?”

Frise continued: “The research we are launching aims to understand why so many companies and individuals are still not changing their behaviour because, ultimately, this has to be about doing the right thing – even when no-one is looking.”

The association, which represents firms responsible for heating, cooling and ventilation systems, said heatwave conditions are becoming more prolonged and dangerous, increasing the urgency of adapting domestic buildings.

BESA said its members have raised repeated concerns about overheating and indoor air quality, particularly in older homes not designed for sustained high temperatures.

Kevin Morrissey, technical director at BESA, said the current situation requires new measures: “We need an urgent rethink about how we cool and ventilate our homes, especially in our existing housing stock.”

He added: “Winter fuel payments were recently top of the political agenda, but a similar summer cooling scheme, targeted at vulnerable members of the population, now deserves serious consideration.”

Health effects and rising temperature trends

According to Morrissey, up to 80 percent of homes in the UK are now regularly overheating during summer.

BESA cited government climate projections showing that UK summer temperatures are expected to rise by between 1.3°C and 5.1°C in the coming decades.

The association warned that the impact of higher temperatures could include reduced productivity and more frequent health emergencies, particularly among vulnerable groups.

Morrissey said: “This will have a hugely detrimental effect on people’s health, wellbeing and productivity.”

He referred to findings from the London School of Hygiene and Tropical Medicine, which suggest that deaths related to the UK’s 2022 heatwave may have been underreported.

The British Medical Journal projects annual heat-related deaths in the UK could exceed 10,000 by 2050.

Need for revised building retrofit policies

BESA highlighted that existing government schemes could be revised to address heat resilience, not just energy efficiency.

Morrissey said the All Party Parliamentary Group for Healthy Homes and Buildings, which is sponsored by BESA, had proposed changes to the Warm Homes Plan, the Great British Insulation Scheme and the Boiler Upgrade Scheme (BUS).

He stated: “Programmes like the Warm Homes Plan, Great British Insulation Scheme and Boiler Upgrade Scheme are designed to improve heating efficiency, but these could equally be used to help people who are just as vulnerable to heat as they are to winter cold.”

Morrissey added that without adequate ventilation and cooling, insulation can contribute to overheating, damp and poor air quality, which can further impact health.

Cooling capabilities of heat pumps

BESA said the government should modify the Boiler Upgrade Scheme to include support for air-to-air heat pumps that offer cooling as well as heating.

According to the association, these technologies are underused despite their potential to reduce overheating and cut emissions.

Morrissey said: “It is a significant drawback that grant funding is not available for air-to-air heat pumps that provide cooling as well as heating.”

He added: “Not only could this help to tackle overheating but would also fuel additional market growth and help to reduce carbon emissions.”

BESA said this approach would be more adaptable and encourage broader uptake of heat pump installations.

Wider strategies for cooling and energy control

BESA cautioned that mechanical cooling alone is not a complete solution.

The organisation said a combination of interventions should be considered, including shading, insulation improvements and smart controls that can moderate energy demand.

Morrissey said: “Mechanical cooling/air conditioning should not be seen as a panacea.”

He added that cooling systems should be part of an integrated retrofit strategy that considers occupant comfort and building performance year-round.

BESA said improving indoor environments during both hot and cold seasons should be central to building regulations and retrofit policies.

Tyne and Wear Fire and Rescue Service has reported that a water safety demonstration was held at Cullercoats Bay this week to promote drowning prevention in advance of World Drowning Prevention Day.

More than 40 people representing local and regional organisations entered the sea to form a floating circle, symbolising the ‘Float to Live’ technique supported by the RNLI and partner agencies.

The event aimed to raise awareness of how simple physical actions can improve survival in the water, particularly during the school holidays when recreational use of the UK’s rivers, lakes and coastline increases.

World Drowning Prevention Day is observed internationally on 25 July, with this year’s theme focused on promoting life-saving knowledge and reducing drowning deaths.

The ‘Float to Live’ method encourages individuals in distress to tilt their head back, stay calm, move their limbs gently, and allow their body to float in place while awaiting help or regaining control.

Emergency services highlight summer water risks

Steve Thomas, Head of Prevention and Education at Tyne and Wear Fire and Rescue Service, said: “With the school summer holidays underway and continued warm weather, we know more people will be heading to the coast, rivers, and lakes to cool off and enjoy the water. Whether it’s a day at the beach or a family break involving water-based activities, it’s vital that everyone understands the risks.”

Thomas added: “As a fire and rescue service, we’re urging the public to be water aware. What starts as fun can quickly turn dangerous without the right knowledge.

Nick Ayers, RNLI Regional Water Safety Lead, said: “The Circle of Life event at Cullercoats Bay was a powerful visual reminder of the importance of water safety and partnership working.

“Seeing over 40 individuals coming together to promote Floating shows just how committed we all are to reducing drowning.”

Ayers added: “Float to Live is a simple but effective technique that gives people the best chance of surviving if they get into trouble in the water.

“When panic sets in, floating helps you to regain control, catch your breath and stay calm until help arrives or you can self-rescue.”

He said: “As we approach World Drowning Prevention Day, we want everyone heading to the coast, rivers or inland waters to remember this life-saving advice. It really can make the difference between life and death.”

He continued: “We want everyone to enjoy the water in a safe way, by practicing this lifesaving technique will enhance your enjoyment in the water, but also preparing yourself in case something goes wrong.”

Seasonal focus on increased drowning risks

According to Jo Talbot, a Director at the Royal Life Saving Society UK, drowning deaths in the UK are more frequent during the warmer months.

Talbot said: “A disproportionate number of people drown in the UK between May and August, and we see an increased number of drownings in periods of extreme heat.”

She added: “With the warmer weather and summer school holidays beginning, it is vital that everybody is aware of how to stay water smart and safe this summer.

“World Drowning Prevention Day serves as an important reminder to everyone to equip themselves with the tools and knowledge to stay safe around water.”

She said: “When choosing a location to enjoy water this summer, we urge the public to visit somewhere with a lifeguard whenever possible, to actively encourage conversations with little ones around the dangers of water, as well as familiarise themselves with the key Float technique and the Water Safety Code to help prevent any tragedies and ensure they stay safe.”

The RNLI advises that the five components of ‘Float to Live’ are:

  • Relax and control breathing

Battery fires prompt safety focus on certified lithium-ion devices

UL Solutions warns on thermal runaway in personal electronics

UL Solutions has reported that lithium-ion batteries used in personal devices may pose a fire risk if they have not been certified for safety.

The company said lithium-ion batteries are widely used in products such as mobile phones, tablets and laptops, but some lack independent certification.

According to UL Solutions, batteries that are not properly tested may enter thermal runaway, which can result in high temperatures, smoke, fire or even explosion.

The organisation said battery fires linked to consumer devices have occurred recently on passenger flights, in homes and on vehicles.

Sherry He, vice president and general manager of Consumer, Medical and Information Technologies at UL Solutions, said: “When consumers shop for devices that use lithium-ion batteries, it is critically important that they understand the safety hazards associated with faulty, malfunctioning or uncertified products.

“Consumers should always look for the UL Mark when buying batteries or devices.

“A UL certification demonstrates that the product has met the applicable safety standards.

“Our commitment to safe, innovative battery technology is essential to our mission of working for a safer world.”

Reported fire incidents linked to battery failures

UL Solutions said several recent incidents involved lithium-ion battery fires.

On 29 May, a Southwest Airlines flight was diverted when smoke came from a passenger’s battery charger.

The day before, the airline had introduced a new policy requiring passengers to keep portable battery packs visible during flights.

The company also reported that a resident in Massachusetts suffered a minor burn when a charging phone exploded and set fire to their bed.

In another case, a portable power bank was identified as the likely cause of a fire that destroyed a South Korean airliner and injured several people.

These incidents were cited by UL Solutions as evidence of the need for proper battery evaluation and testing.

UL certification and the UL Mark

UL Solutions said third-party certification helps manufacturers confirm that battery products meet established safety and performance criteria.

The company said its services include evaluation, testing, inspection and certification of various battery types, including standby, primary and secondary models.

It added that its expertise in lithium-ion battery chemistry allows for more accurate identification of risk.

UL Solutions recommended that consumers always check for the UL Mark on devices and batteries to confirm safety compliance.

The company said its Product iQ® database is free to use and helps consumers and businesses identify certified products.

Air travel and battery fire containment

UL Solutions noted that lithium-ion batteries pose a particular concern in aviation settings.

The company said most airlines now carry battery fire containment bags on board to isolate any devices that may catch fire in flight.

To support the safe use of these containment bags, UL Solutions conducts testing against UL 5800, its Standard for Safety for Battery Fire Containment Products.

These assessments are designed to confirm that containment bags can manage the extreme conditions caused by thermal runaway events.

The company said its testing covers temperature resilience, pressure handling and fire suppression capabilities.

Policy change and battery safety in e-bikes

UL Solutions said faulty batteries in e-bikes have also caused fires in urban areas.

The company highlighted Local Law 39 in New York City, which mandates third-party certification of e-mobility devices and batteries in line with UL standards.

According to UL Solutions, early data suggests the regulation has been associated with a drop in fire-related deaths and injuries.

It added that applying similar certification rules across a wider range of products could have public safety benefits.

New UK fire safety law targets online marketplaces selling unsafe products

UK law enacted to address fire risks from online sales

The UK Department for Business and Trade has announced the Royal Assent of the Product Regulation and Metrology Act, expanding fire safety enforcement powers in response to risks posed by lithium-ion batteries sold online.

The department said the new law aims to align online marketplaces with the same product safety requirements that apply to traditional retailers.

The change follows concern over a rising number of fires caused by unsafe e-bike and e-scooter batteries, often bought through digital platforms.

According to the Office for Product Safety and Standards (OPSS), there were 211 reported fires involving these products in 2024, with 175 incidents reported by London Fire Brigade alone.

The new law will allow regulators to hold online marketplaces accountable for ensuring the safety of products sold through their platforms.

Requirements for online marketplaces under new framework

The UK Government intends to introduce specific obligations for online marketplaces in line with the Product Regulation and Metrology Act.

These obligations include preventing the sale of unsafe products, ensuring sellers meet safety responsibilities, providing product information to consumers, and supporting regulatory investigations.

The Office for Product Safety and Standards will continue its targeted activity, including oversight of button batteries, small magnets, and lithium-ion battery products.

The Government said these measures are designed to create a proportionate and balanced framework that supports both consumer safety and business growth.

According to the department, around 300,000 businesses operate in regulated product sectors across the UK, with a combined estimated turnover of £490 billion.

The OPSS’s public campaigns, such as the “Buy Safe, Be Safe” initiative and its December 2024 lithium battery guidance, will continue alongside the new enforcement approach.

Product Safety Minister Justin Madders said: “By giving regulators the teeth to clamp down on unsafe products, we’re ensuring people can shop with confidence whether online or on the high street.

“This will establish a level playing field and mean online marketplaces are held to the same high standards as bricks and mortar shops, ensuring we back businesses and protect consumers as part of our Plan for Change.”

Rocio Concha, Director of Policy and Advocacy at Which?, said: “Which? has campaigned for years to hold online marketplaces to the same standards as high street retailers. For too long, consumers have been exposed to dangerous – and in some cases lethal – products.

“The Product Regulation and Metrology Act has the potential to be a game changer for consumer safety. It paves the way for new laws to clarify and strengthen responsibilities for online marketplaces, which is crucial in the fight against the sale of dangerous products online.

“Following the bill’s Royal Assent, the government must act fast to tighten definitions of online marketplaces, introduce a clear duty so that online marketplaces are accountable for product safety, and empower regulators to issue heavy fines for those that fall short of the required standards.”

London Fire Brigade and safety groups support the legislation

London Fire Brigade Deputy Commissioner Charlie Pugsley said: “We are pleased that the Product Regulation and Metrology Bill (PRAM) has been granted Royal Assent.

“London Fire Brigade sees one e-bike or e-scooter fire every two days and we have long called for regulation to improve product safety and safeguards on online marketplaces to protect people from buying dangerous products that pose a fire risk.

“We welcome this new piece of legislation, which will better regulate unsafe products being sold and help to protect the public from unsafe products and particularly poor quality or non-compliant lithium battery products, which can present unique fire safety challenges.”

John Herriman, Chief Executive at the Chartered Trading Standards Institute, said: “Alongside the coalition, which included the British Toy and Hobby Association and Electrical Safety First, we welcome the Product Regulation and Metrology Bill gaining Royal Assent as a positive step forward in ensuring the UK maintains strong, modern protections for consumers.

“This legislation supports the vital work Trading Standards does in keeping unsafe and non-compliant products off the market, creating a fairer and safer trading environment for businesses and consumers alike.

Electrical Safety First welcomes new legislation and calls for strong follow-up regulations

Lesley Rudd, Chief Executive of Electrical Safety First, said the new law marks a turning point in product safety legislation.

Rudd said: “This legislation has the potential to transform our product safety laws, making them fit for the 21st century.

“We now have an opportunity to address new and emerging product safety risks – particularly the threat posed by substandard e-bike batteries, which continue to cause ferocious fires across the country, and the ‘wild west’ of online shopping, where dangerous goods are relentlessly sold.

“Whilst we welcome the Bill’s enactment and the speed at which the Government has moved, the forthcoming consultations must be bold, brave and robust to effectively tackle the serious risks posed by substandard e-bike batteries and dangerous goods sold online.

“These batteries and modified devices continue to cause life-threatening fires, injuring and tragically, in some cases, killing people in their homes.

“Strong new rules are urgently needed to keep poor-quality batteries and accessories off the market.

“Online marketplaces must finally be held legally responsible for the safety of products sold through their platforms.”

According to Electrical Safety First, it secured several amendments to the bill, including measures to improve transparency in assessing new risks, guaranteed rights to consultation, and a government commitment to regulate e-bike batteries.

The organisation said it has played a leading role in raising awareness of fire hazards from substandard lithium batteries.

Its 2022 report, Battery Breakdown, outlined the increasing risks associated with poor-quality e-bike batteries and proposed detailed policy interventions.

Electrical Safety First has also identified banned or unsafe batteries for sale on online platforms, including a UPP model linked to multiple fire incidents and found listed on Facebook Marketplace.

The charity is advocating for new mandatory safety standards for conversion kits and charging systems to address incompatibility risks and reduce battery-related fires.

It has also called for a legal redefinition of online marketplaces to make them formally accountable under UK safety law.

Economic and safety context for regulatory reform

The Government said the regulatory changes were designed to reflect the evolving nature of the marketplace and increasing dependence on online platforms.

More than 8,600 Fire Hazard Abatement Notices (FHANs) have been issued in Hong Kong following inspections of older high-risk buildings, according to the Government of the Hong Kong Special Administrative Region.

The fire safety inspections followed a 2024 fire at New Lucky House in Jordan that resulted in five deaths and 40 injuries.

The government reported that among around 1,000 composite buildings inspected, over 2,100 FHANs were issued to “three-nil buildings”, which have no owners’ corporation, no management company and no residents’ organisation.

District-level figures show that Sham Shui Po received the highest number of FHANs at 1,074.

A total of 324 successful prosecutions and convictions were secured across the 18 districts.

The most common cause of prosecution was smoke stop door irregularities, accounting for 259 cases.

Compliance rate and new inspection plans

As of the end of June 2025, the Fire Services Department (FSD) reported that over 90 percent of the 8,661 issued FHANs had been complied with.

In March 2025, the FSD created the Divisional Public Safety Team to increase district-level enforcement and community engagement across Hong Kong Island, Kowloon and the New Territories.

The department stated that it will proactively inspect 1,800 old buildings over the next year.
