How do you solve a problem like high rise building safety?

IFSJ looks at the UK government’s changes to the 2005 Fire Safety Order affecting high-rise buildings across England

Last month marked five years since the devastating fire that destroyed Grenfell Tower and claimed the lives of 72 of its residents. Following the disaster, the UK government launched the Grenfell Tower Inquiry Phase 1 in a bid to safeguard against history repeating itself.  Soon to be introduced under article 24 of the Regulatory Reform (Fire Safety) Order 2005 (Fire Safety Order), the government is implementing the majority of those recommendations triggering a change in the law set to come into force on 23 January 2023.

What happened

Following the Grenfell Tower Fire, the Government established in August 2017 the Independent Grenfell Tower Inquiry. The Inquiry published its first Phase report in October 2019. This report made several recommendations which the Government, in principle, accepted.

Following a call for evidence from the Home Office’s in response to the Independent Review of Building Regulations and Fire Safety, the Home Office launched the Fire Safety Consultation which ran from 20 July to 12 October 2020. Section 2 of the Consultation outlined the intention to lay regulations under article 24 of the Fire Safety Order to implement the Inquiry’s recommendations which required a change in the law. It also included proposals to implement the recommendations in a practical way.

The Government’s response to the Fire Safety Consultation was published on the 17 March 2021 and demonstrated broad support for these proposals. Following the commencement of the Fire Safety Act 2021, it was clarified that the Fire Safety Order applies to a buildings structure, external walls and any common parts of premises including all flat entrance doors for buildings containing two or more sets of domestic premises.

The regulations sit alongside the Building Safety Act amendments to the Fire Safety Order. The Government’s overhaul of supporting guidance issued under the Fire Safety Order aims to improve fire safety outcomes designed to protect the public from the risk of fire by better supporting compliance and effective enforcement in all regulated premises.

The new regulations

The Fire Safety Regulations 2022, which apply only to England will make it a requirement in law for responsible persons of high-rise blocks of flats to provide information to Fire and Rescue Services to assist them to plan and, where needed, provide an effective operational response.

In all multi-occupied residential buildings, the regulations require responsible persons to provide residents with fire safety instructions and information on the importance of fire doors. The regulations apply to existing buildings, and requirements for new buildings may be different.

On of the foremost requirements regards a premises’ secure information box which will become a legal requirement for all buildings that fall under the high-rise category. The regulations will require the responsible person to install a suitably secure information box in or on their high-rise building. They will also be required to provide in the box: their UK contact details, the UK contact details of any other person who has the facilities to and is permitted to access the building as the responsible person considers appropriate, copies of the building’s floor plans which identify specified key fire-fighting equipment. Their contents will be required to be kept up to date in line with the duties imposed by the regulations and the Fire Safety Order.

Responsible persons will also have to provide to their local Fire and Rescue Service information about the design and materials of a high-rise building’s external wall system and to inform them of any material changes to these walls. They will also be required to provide information in relation to the level of risk that the design and materials of the external wall structure gives rise to and any mitigating steps taken.

They must also legally provide their local Fire and Rescue Service with up-to-date electronic building floor plans and to place a hard copy of these plans, alongside a single page building plan which identifies key firefighting equipment, in a secure information box on site.

Monthly checks on the operation of lifts intended for use by firefighters and evacuation lifts in their building and check the functionality of other key pieces of firefighting equipment must be carried out. Any defective lifts or equipment must be reported to local Fire and Rescue Service as soon as possible after detection if the fault cannot be fixed within 24 hours. Records of the outcome of checks are to be made available to residents.

Whilst not a legal requirement under the new legislation, installing wayfinding signage has been recommended in all high-rise buildings to assist the Fire and Rescue Service in navigating their way round a building even when visibility is low.

Multi-occupied residential buildings in with two or more sets of domestic premises which have common parts must provide residents with fire safety instructions. Responsible persons should make sure that these instructions are shared with their residents in a form that residents can reasonably be expected to understand with instructions on: how to report a fire, a reminder of what the evacuation strategy is for that building, information on the importance of fire doors to a building’s fire safety and any other instruction that tells residents what they must do once a fire has occurred, based on the building’s evacuation strategy

In residential buildings with storeys over 11 metres in height, responsible persons will be required to undertake quarterly checks of all fire doors (including self-closing devices) in the common parts and undertake annual checks of all flat entrance doors, including self-closing devices, that lead onto a building’s common parts.

Personal Emergency Evacuation Plans

The Personal Emergency Evacuation Plans (PEEPs) in high-rise residential buildings consultation set out how the Government proposed to implement the two relevant Grenfell Tower Inquiry Phase 1 Report recommendations: that responsible persons of every high-rise residential building be required by law to prepare personal emergency evacuation plans (PEEPs) for all residents whose ability to self-evacuate may be compromised, and be required by law to include up-to-date information about persons with reduced mobility and their associated PEEPs in the premises information box.

The PEEPs consultation response revealed that a large majority of respondents supported the proposal to require the Responsible Person to prepare a PEEP for every resident who self-identifies to them as unable to self-evacuate and do so in consultation with the residents.

However, the consultation responses highlighted significant concerns over the proportionality, the practicality, and the fire safety case for PEEPs in all high-rise residential buildings. They found that whilst respondents were strongly in favour of any measures that improve the fire safety of residents who are unable to self-evacuate, there were serious concerns over increasing the risk of harm to those being evacuated.

There was also the issue of execution: If the PEEPs requirement were extended to all multi-occupied buildings, as advocated by some responses to the consultation, it would increase the number of buildings covered from around 12,000 buildings, to approximately 1.7 million in England.

The Government has since launched a new consultation, including a proposal on Emergency Evacuation Information Sharing (EEIS). The new proposal focuses on residential blocks of flats with a simultaneous evacuation strategy in place. In these buildings, responsible persons would be required to ask residents to make themselves known if they feel they might need support to evacuate in the event of a fire. The consultation will close on 10 August.

Who is liable?

The High Court in London delivered a landmark judgment that establishes legal liability for remedial safety work on buildings in a ruling that could help resolve one of the biggest unanswered questions from the Grenfell Tower fire. In the recent ruling, Essex-based contractor Mulalley & Co was ordered to pay damages towards the cost of removing cladding it had fitted to four residential tower blocks in Gosport on the south coast of England which had been deemed unsafe after the Grenfell blaze.

The ruling marks is the first time financial liability for remediation work on unsafe cladding has been established in court. It is thought that the outcome could have far-reaching ramifications for leaseholders, building owners and contractors in England.

Andy Hulme, chief executive of housing association Hyde Group which brought the claim via its subsidiary Martlet Homes against Mulalley, said the case had ‘massive implications for the market’. He said it should help unblock disputes between leaseholders living in blocks fitted with flammable cladding and the buildings’ owners over who should pay to have it removed.

“It’s the first time a contractor has been held accountable for the quality of work and the materials they have used,” he said. “Based on this case we now know where the lines of accountability lie.”

The court has yet to decide what the extent of the damages will be. According to reports Hyde is looking to recoup as much as much as possible of the £8 million it spent fixing the blocks. Criminal proceedings are expected to follow. Ahead of the inquiry laying out its conclusions, the High Court’s ruling could provide a legal precedent and a new path for leaseholders and property owners to recoup the costs of fixing blocks found to be unsafe in the aftermath of Grenfell.

Mary-Anne Bowring, a fire safety expert and group managing director at property consultant Ringley Group, said of the ruling is: “A landmark that gives hope to millions of residents living in unsafe buildings by opening the potential for legal action against other construction contractors who installed unsafe cladding”. She added, however, that: “It is not enough to simply expect developers and housing associations to launch further legal action off the back of today’s judgment in order to recover the money spent on fixing unsafe buildings.”

High-rise fires are not an issue confined to the UK – just look at the Bronx apartment Fire in January which claimed the lives of 17 people or Taiwan’s Kaohsiung tower fire last October which killed 46. Whilst the new Building Safety Act will hopefully resolve some of the issues in the UK, there is still a way to go before residents around the world can sleep easy knowing their homes are safe.

Scottish ministers called out over slow response to cladding crisis

Scottish ministers have been called out over the slow action surrounding the removal of Grenfell-style cladding on public buildings as the bulk of the removal work is earmarked for 2025.

The Scottish Government’s spending review pledged £180 million over three years to remove the potentially harmful insulation. The vast majority of funds equating £100m, however, will be allocated in 2025/26, while a £30m budget will start in 2023/24, increasing to £50m in 2024/25.

The cladding remuneration programme, which aims to replace insulation in high-risk buildings which are fitted with aluminium composite material, was initially expected to be rolled out in 2022.

A freedom of information request revealed that more than 100 public buildings, including hospitals and more than 80 primary and secondary schools, are believed to contain the potentially flammable material similar to that which caused the devastating fire at Grenfell tower in 2017.

Mark Griffin, Scottish Labour’s housing spokesman, asked for an update on how many surveyors and fire engineers had been procured to carry out single building assessments earlier this year. Housing minister Shona Secretary replied that 29 buildings had been contacted so far to offer the direct provision of fire engineers, adding that Once they ascertain consent and details, they will move to the contracting process.

A Scottish Government spokesperson said: “Our ban on combustible cladding from domestic and other high-risk buildings applies on buildings of 11m and higher, whereas elsewhere in the UK it is 18m. We have also banned the highest risk metal composite cladding material from any new building of any height.”

“The vast majority of buildings in the initial phase of our programme have secured fire engineers.”

“A new streamlined process for commissioning the assessments will help identify at-risk buildings more quickly. We still expect the vast majority of buildings assessed through this programme to be found to be safe. We have allocated almost £400m to this programme of work.”

EU mobilises to join fight against Portugal forest fires

The European Commission has deployed two firefighting airplanes to support Portugal with the country’s ongoing wildfire emergency.

Following a request for assistance, the EU Civil Protection Mechanism facilitated the immediate pre-positioning and then deployment of two Canadairs from Greece, which are currently operating in the most affected districts in northern Portugal.

On this occasion, Commissioner for Crisis Management Janez Lenarčič said: “As wildfires continue to threaten people and resources across our continent, we need to stay alert and ready to deploy assistance as rapidly as possible from fire breakouts. We stand in solidarity with Portugal facing this emergency and have mobilised planes from Greece who are putting European solidarity into action.” 

The EU’s Emergency Response Coordination Centre is in close contact with Portuguese authorities to support the coordination of firefighting operations in the area and mobilise further assistance in case of need.

In addition, the EU’s Copernicus satellite service has been activated to collect data vital to first responders on the areas burned. 

Growth opportunities ahead as fire protection material market grows

The rapid growth of the construction industry is expected to cause growth in the Fire Protection Material market going forward due to the latter’s wide use at construction sites to protect users from fire.

Fire Protection Material Market size was valued at USD 2.8 billion in 2021 and is expected to reach USD 5.98 billion by 2029. It is projected to grow at a compound annual growth rate of 8.8% from 2022 to 2029.

Fire protection materials are those used in applications that help ensure safety of buildings from hazards associated with fire including fire detection, coupled with fire suppression through manual or automatic means which aid in curbing fire and damages resulting therefrom. 

The Fire Protection Material market is anticipated to grow with the implementation of fire safety regulations and strict building codes.

There is also a demand for automotive power and utilities, mining, petroleum, chemicals, and oil and gas exploration. These factors have the potential to shape the market path from 2022 to 2029. 

North America is expected to account for the largest market share in the fire protection materials market during the forecast period. 

According to the US Census Bureau, construction spending during February 2022 was estimated at USD $1,704.4 billion compared to USD $1,533.3 billion in February 2021. Around 1,859,000 building permits and 1,769,000 housing permits were authorized in February 2022 as per the latest data provided by the US Census Bureau and US Department of Housing and Urban Development.

Operation Willow Beck supports fire service during extreme weather period

Following extended periods of extreme weather in the UK in recent weeks, the National Fire Chiefs Council NFCC supported process Operation Willow Beck has reportedly seen extensive use. 

The process designed in collaboration between the Home Office, the NFCC Mobilising Officers Group, the NFCC Fire Control Room Project and British Telecom is designed to mitigate increased emergency call volumes during spike conditions, such as flooding or wildfires. 

Surrey Fire and Rescue Service, one of the services that implemented Operation Willow Beck in their Joint Fire Control Room, reported to National Operational Learning about the experiences on the day allowed a 65% reduction in calls being handled by Surrey, ensuring that risk critical calls could be handled in a timely manner and all callers received a response without over burdening a single buddy control room.

BT also indicated the benefits to call management were clear allowing them to pass more calls and reducing manual processes saving time and getting the caller a response faster. 

The NFCC said this demonstrated the importance of the process as while events such as these are rare they are becoming more common and more severe, meaning services will be under extreme pressure and capacity stretched

NFCC said: “We will be using all National Operational Learning cases submitted regarding these periods, to improve the existing processes, and we encourage all fire and rescue services to share vital feedback with National Operational Learning to allow us to continue to learn and improve. 

“We also urge you to consider doing more to embed Operation Willow Beck, National Talk Group 20, supporting National Operational Guidance for Fire Control and other processes designed to reduce stress on service capacity, so when they are needed, they work as well as they did for Surrey.”

US aviation soldiers assist with Kosovo wildfires

Aviation Soldiers assigned to Kosovo Force’s Regional Command-East have been working together since their arrival in the region to enhance their aerial firefighting capabilities.

They have assisted in combatting wildfires utilising the force’s crew chiefs, pilots, command staff and the Soldiers who perform maintenance on the Bambi buckets used to drop massive amounts of water to extinguish large fires.

2nd Battalion, 224th Aviation Regiment of the Virginia National Guard, implemented training to bring their aviation crews up to standard and certify anyone who has never used the Bambi bucket. Crews use local lakes for training, and even after Soldiers are certified, the aviation teams continue to train because a call to fight a fire can come in at any second.

Kosovo is prone to wildfires due to farmers participating in agricultural burning to cultivate fields and clear stubble, weeds, and waste, for the continued production of crops. If these fires are not kept under control, they have the potential to turn into larger fires that threaten Kosovo villages and forest habitats.

Chief Warrant Officer 3 Darrell Busquets, the battalion standardisations instructor pilot assigned to Bravo Company, said: “Before our pre-mobilization, we got word that there were Bambi buckets here in Kosovo and that KFOR 29 fought fires up in the western side of Kosovo during their rotation.”

He added: “That prompted us to put our aviators through Bambi bucket qualifications. Once we got into Kosovo, we continued to keep current on the Bambi bucket operations. The training makes our crews more cohesive when we get called to do real life operations.”

Fourth edition of the Simultaneous Evacuation Guidance published

A new edition of the industry guide The Simultaneous Evacuation Guidance (SEG) has been published. The fourth of edition of the guide was coordinated by NFCC in partnership with a range of stakeholders and replaces the third edition published in October 2020.

The latest edition, which has been put together by fire safety professionals, seeks to actively discourage the ongoing and prolonged use of a waking watch, makes a number of updates and improvements to discourage building owners from having onsite staffing where this may not be needed.

Key aims of the guide are to Ensure that those with responsibility for buildings fully understand the decision-making process before deciding that a change in evacuation strategy is required, to put a clearer emphasis on resident engagement. and to put an end to risk averse ‘one size fits all’ application of on-site staffing (waking watches or evacuation management) when this is disproportionate to the risk.

Mark Hardingham, Chair of the National Fire Chiefs Council (NFCC) noted commented: “After consulting on the draft with a range of stakeholders and leaseholder groups, over 500 comments were received. The new edition is much clearer about evacuation management, and the difference between general fire safety actions, compared to full-time jobs or continuous activities like patrolling.

“Data collected from English Fire and Rescue Services shows that buildings known to have a waking watch (of all heights) fell by nearly 63% between June 2021 and March 2022, from 773, to 288. I’m really pleased to see this tracking down, and hope this trend will continue.”

After consulting on the draft with a range of stakeholders and leaseholder groups, over 500 comments were received.

Dennis Davis, Executive Officer of the Fire Sector Federation added: “The decision-making process to be followed before any change is made to a building’s evacuation strategy, should be proportionate, reflecting the risk presented based upon a holistic consideration, inclusive of the Fire Risk Assessment.

“We hope this new guidance will help Responsible Persons (RPs) and Fire Risk Assessors to act proportionately, by ensuring they are following the most up to date guidance, and in so doing take the right steps before they change their evacuation strategy.”

Gavin Tomlinson, Chair of the NFCC’s Protection Scrutiny Committee added, “We have repeatedly called on building owners to consider a wide range of risk mitigations including the installation of common fire alarms to reduce or remove the dependence on waking watches and onsite staffing, and this is the clear expectation for buildings where remediation cannot be undertaken in the short term.”

“I’m pleased that edition four reinforces the need to support the safety of all residents where the competent risk assessor’s advice confirms a change in the evacuation strategy is required; whilst ensuring the measures in place are proportionate, and backed up by plan for remediation as quickly as possible.”

Delhi Fire Service clears building fire safety proposals

The Delhi Fire Service (DFS) has cleared seven proposals for fire safety systems in buildings being constructed under the Government’s Central Vista Project. The proposals were cleared by the DFS after the building designs were presented for approval by the government as senior official said.

Each of the seven proposals consist of plans for more than two building. These buildings include New Parliament Building, New PMO building, Amenity block, and Common Central secretariat being made under the Central Vista project, and a few other office buildings.

various in-built fire-fighting arrangements are recommended to be installed in the buildings such as a fire exit, a hose reel, a wet riser, hydrants, an automatic sprinkler system, internal hydrants and yard hydrants, pumping arrangements, and captive water storage for fire-fighting, the fire officers said.

Automatic fire detection and alarming system, manual-operated electric fire alarm system and a public address system are also recommended in the National Building Code of India Chapter 4 on fire and fire safety.

“All the recommendations suggested are being followed and implemented in the building designs which had altered,” the officer said. Atul Garg, Director of DFS said.

“The buildings under the Central Vista project have state-of-the-art technology as far as the fire department is considered. We have tried to provide the best infrastructure for the fire safety system. This is going to have in-built fire safety systems with a set up of a huge fire control room as well.”

The fire officials said that initially it was not easy to convince the architects of the project to make certain specific changes in terms of fire safety system as they were of the view that any such changes could affect the beauty of the buildings.

Equivalent of 16 football pitches lost to forest fires every minute

Forest fires are burning twice as much global tree cover as 20 years ago according to new data published on Wednesday (17 August) which shows the equivalent of 16 football pitches are now lost every minute.

Researchers from the University of Maryland used satellite imagery to map areas of tree cover lost, including that burned by what are known as stand-replacing forest fires – fires that kill all or most of the forest’s canopy and which cause long-term changes to forest structure and soil chemistry.

The research revealed in great detail how wildfires have progressed over the past two decades with the blazes claiming an estimated three more million hectares each year – an area approximately the size of Belgium – compared with 2001.

The study also showed that the majority of tree cover loss is occurring in the boreal forests that blanket much of Russia, Canada and Alaska.

Around 70% of fire-related tree cover loss over the last two decades occurred in boreal regions, likely because high-latitude regions are warming at a faster rate than the rest of the planet.

Last year, Russia lost 5.4 million hectares of tree cover due to fires, the highest on record at an increase of 31% over 2020.

The study said: “This record-breaking loss was due in part to prolonged heatwaves that would have been practically impossible without human-induced climate change.”

“Forest fires are getting worse worldwide,” James McCarthy, research analyst at Global Forest Watch, told AFP.

“In these boreal regions carbon has accumulated in the soil over hundreds of years and has been protected by a moist layer on top.”

Forest fire devastates Northern Algeria

At least 26 people have been killed and dozens more injured on Wednesday in forest fires that decimated parts of northern Algeria, the country’s interior minister Kamel Beldjoud said.

In El Tarf, near the border with Tunisia, 24 people were killed as well as a mother and daughter in Setif. Firefighters, supported by helicopters, were still trying to contain several blazes on Wednesday evening and around 350 residents have been evacuated across various provinces.

Wednesday’s toll brings the total number of Algerians killed in wildfires this summer up to 30.

The civil protection agency said that El Tarf was the worst hit area with 16 fires in progress.

Northern Algeria sees forest fire activity every year with 90 people thought to have died as a result last year and more than 100,000 hectares of woodland burnt.

Last August, Beldjoud blamed a spate of fires in Algeria’s Kabyle region on arson. He claimed “only criminal hands” could explain “the simultaneous outbreak of about 50 fires across several localities”.
